Well indeed no, donation is free and not related to nothing, it's not a pay for a service you could take, it's a spontaneous "donation" as the word itself said.
Foundation can accept donation in fact, ( i study law in my country).
Keep the server cost is not something lucrative, if you spend 100 euro for the server cost and you accept until 100 euro for server mantenience it's all regular from a legal point of view.
It would be even if you accept 1000 just the money should remain into and only for the project and not at disposal of ppl that work on it.
