This situation is equivalent to some random idiot acting up, sticking his finger in your chest.
a) You can retaliate.
b) Ignore the guy and move on.
c) Report him to the police (civil harassment?).

If you go with c) you should prepare yourself for some banter.

just because there are obstacles that doesn't mean they can't be circumvented. that's where the fun is

slyrim is a bad example of an open world game - think morrowind. you were fully encouraged to break every "rule" the game imposed upon you in order to achieve greater and more interesting things. some people see others breaking 'rules' and think "that's awesome, i wanna do that." others get scared, jealous or don't have the creativity to do it and so want to stop anyone else from doing it

i dub them the no fun police and it seems that ototo is running for superintendent

What you described is the difference between "sandbox" and "themepark" MMOs.

Example of a themepark MMO: WoW, the players play the content, everything is planned/scripted, there is a constant flow of new content needed to keep the players busy

Example of a sandbox MMO: EvE online (not 100% sandbox), the players "are" the content, it's up to the players what they do to have fun in the game

Normally PvE content is more in themepark style and open PvP content is more like sandbox.

In the case of WAR it's a mixture:
The capturing mechanic of areas is basically "moderated" by the game (e.g. zone locks) so this is more a themepark element.
But the players decide which area and which BO to capture, so this is more like a sandbox element.

More on topic :D :

The problem of a sandbox is, that you normally need a NPC police (like CONCORD in EVE) to avoid that the new/undergeared players are getting harassed too much by old/twinked players.

I like the idea of "WAR is everywhere", but i think this game lacks basic mechanics to balance this out.

If everytime someone is killing repeatedly enemies in PvE, a group of champs would roam the area to find the intruder(s), this would be different (could be witch hunters, warrior priest and flagellants for empire areas or maiden/phoenix guard for high elfs etc).
There are also other countermeasures needed to avoid that players are simply escaping after some kills by using the book or war report etc. pp.
After a crash/relog the intruders(s) must still have the "wanted" status. It should fade after some ingame time has passed without killing any players.
The deaths of the intruders should mean something in the game (maybe contribute 2x to zonelocks).

The statues in altdorf/IC of the players with the most renown are pretty pointless, as they normally show the players with the most playtime.
Maybe there could be a bounty on the most wanted players and the statues of them are displayed here (destro players in AD and order players in IC). When you mouseover the statues it could show the actual bounty under the name. So these statues would be more like "archenemies" of the realm.
Maybe there could be other factors, that raise your archenemy status.

But this for the far far future (if even remotely possible).

Just wanted to point out, that "borderless" PvP can be very unhealthy for the game, when new/inexperienced players are harassed constantly without some protection.

You were the one admiting exploiting every possible way to jump over the other persons wishes. Thats called RESPECT, a concept that may be completely new for you.
